Terms and Conditions
The agreement between you and MERRE: what the service does, what it does not promise, and the consumer rights that no clause here can take away.
These Terms and Conditions (the “Terms”) govern access to and use of the MERRE mobile application, the website at merre.app, and the related account, AI-assisted travel-planning, cloud-backup and subscription services that the operator actually makes available (together, the “Service”).
The operator is referred to as “MERRE,” “we,” “us,” or “our.” A person using the Service is referred to as “you.”
1. Important consumer notice
These Terms do not exclude, restrict or replace rights that Romanian or other applicable consumer law makes mandatory. If you are a consumer habitually resident in another EEA country and MERRE directs the Service to that country, the choice of Romanian law does not deprive you of mandatory protection available under the law that would otherwise apply to you.
MERRE is a travel-record and AI-assisted planning tool. It is not a public authority, immigration adviser, medical provider, emergency service, financial adviser, insurer, travel agent, package-travel organiser, carrier, accommodation provider or booking merchant. Third-party travel services remain subject to their provider's terms.
2. How the contract is formed
Before creating an account, you can access these Terms and the Privacy Notice through separate links next to the Google sign-in action. By pressing Continue with Google, you:
- confirm that you are at least 18 years old;
- agree to the then-current version of these Terms; and
- acknowledge that you have been given the Privacy Notice.
Acknowledging the Privacy Notice is not consent to all data processing. Optional product analytics and crash diagnostics require the separate choices described in the Privacy Notice and the app. Personalized recommendations has a separate service preference. MERRE does not treat acceptance of these Terms as consent to optional tracking or special-category processing.
MERRE records the applicable document versions/hashes, displayed acceptance text, adult assertion, app version, locale, authentication provider and server timestamp. If this record cannot be created, account access is not granted. Materially changed Terms may require a new acceptance.
The contract language is English. Any translation is provided for convenience unless mandatory law requires the translated text to control. MERRE makes the accepted version available through the website and records its version and cryptographic hash with the acceptance record. Material updates receive a new version; prior versions are retained for contract evidence.
3. Operator information
The operator information for these Terms is:
- legal name/legal form: KRISZTIÁN PALLAGI, currently an individual;
- registered or professional service address: Strada Constantin Noica 7, 410490 Oradea, Romania;
- effective email address: wander.travel.app1@gmail.com;
- Romanian trade/professional registration number: none;
- fiscal/VAT identifier: none represented; Google Play supplies the transaction-specific tax presentation it controls;
- competent authorisation or professional body: none applicable to the currently described software service; and
- single point of contact for users and authorities, including under the EU Digital Services Act: wander.travel.app1@gmail.com, in English or Romanian.
4. Eligibility and adult-only use
You may use MERRE only if:
- you are at least 18 years old;
- you have legal capacity to enter the contract;
- you provide a Google account that you are authorised to use;
- your use is lawful in your location; and
- you are not prohibited from receiving the Service under applicable sanctions or trade restrictions.
MERRE does not offer child accounts. An adult may plan a trip involving children, but remains responsible for that information and must provide only what is necessary. Child age bands should be used instead of exact dates of birth or exact ages where practical.
MERRE may request a renewed age assertion or proportionate verification if it reasonably suspects an account belongs to a minor. The present clickwrap is a contractual assertion, not identity-grade age verification.
5. Accounts and security
Google Sign-In is the active authentication method. You must:
- provide accurate account information;
- keep your Google account and device secure;
- not share or transfer your MERRE account;
- promptly notify MERRE of suspected unauthorised use; and
- keep your device and operating system reasonably updated.
You are responsible for activity carried out through your account to the extent caused by your acts or failure to take reasonable security precautions. This does not make you responsible for a compromise caused by MERRE or a provider for which the law places responsibility on MERRE.
MERRE may apply device attestation, rate limits, integrity checks and proportionate anti-abuse controls. Attempting to bypass them is prohibited.
6. The free Service and MERRE+
The Service includes a free layer and an optional subscription called MERRE+. The free layer is local-first and includes available map, Been/Lived/Wish, saved-place, history and standard AI-planning functions. Completed generated plans and attached Guides are saved to the signed-in account and can be recovered independently of MERRE+. MERRE+ adds premium AI routes and eligible broader travel-history backup once server-verified entitlement is active.
Cloud photo backup is not part of MERRE+. “Unlimited,” “priority” or similar claims form part of the contract only when the purchase screen states a precise, currently available benefit.
MERRE+ advanced AI routes and cloud-backup rights are verified by the server. A client-side premium flag does not create entitlement.
7. Local-first storage and backup
MERRE is designed to store the principal travel record locally on the device. Removing the app or losing the device may remove local-only data. MERRE is not responsible for loss caused solely by a user's deletion or device failure, except to the extent applicable law imposes responsibility. An active MERRE+ entitlement does not convert excluded local-only categories into cloud-backed data.
Subscription backup is not continuous general sync. MERRE+ provides eligible visit/country-history backup through guarded checkpoints. Completed account plans and their Guides are a separate account service, available independently of subscription status; subscription expiry does not erase them. Private cloud Memories are separate and quota-controlled. App settings, live location, map preferences, raw imported files and raw EXIF are not included in compact backup. An onboarding home base may be stored separately in the account profile, not as live-location history.
After subscription expiry, the backup lifecycle stops new backup writes and allows 30 days of read-only restore, export and delete access before scheduled cloud deletion. Account deletion is separate and is intended to remove account-associated cloud data regardless of subscription, subject to legally required retention.
You should export data you wish to keep before an expiry or deletion deadline. MERRE will use reasonable care to operate backup as described but does not guarantee that backup can replace independent copies of important records.
8. AI-assisted features
MERRE uses Google Gemini-family models and supporting place/search providers for itineraries, destination research, Guides, recommendations and refinement. Booking extraction uses native on-device tools and a local parser, not Gemini. General Guides generated independently without Google Search grounding may be reused across travellers; personal planning inputs and grounded research do not enter that shared catalog. Model routes may vary by feature, subscription tier, availability and controlled rollout.
AI output is generated probabilistically. It may be inaccurate, incomplete, inappropriate, fabricated, stale or inconsistent. You must independently verify information that can affect travel, money, legal status, health or safety, including:
- visa, passport, entry, customs and immigration requirements;
- laws, official advisories and local restrictions;
- health, vaccination and accessibility information;
- emergencies, weather and personal safety;
- routes, transport schedules and travel time;
- opening hours, ticket rules and availability;
- prices, exchange rates, cancellation rules and booking terms; and
- whether a place or activity is suitable for you or your companions.
Where MERRE shows a source or freshness date, that assists verification but is not a guarantee. Entry guidance is informational and must be checked with official authorities. MERRE must not be used as the sole basis for an immigration, legal, medical, financial or emergency decision.
You can edit generated itineraries. MERRE does not use the Service to make decisions producing legal or similarly significant effects about you.
To the maximum extent permitted by law, MERRE is not responsible for a user's decision to rely on unverified AI or third-party information contrary to these clear limitations. This does not exclude liability for MERRE's own fraud, intent, gross negligence, mandatory conformity duties, data-protection breach or any liability that cannot lawfully be excluded.
9. Booking imports, confirmations and travel records
Booking extraction is an organisational aid. You must compare extracted dates, names, locations, prices, confirmation codes and other details with the original booking. The original provider's confirmation controls.
Do not upload passport scans, complete payment-card details, medical documents or other unnecessary sensitive data. If you provide another person's information, you represent that you are authorised to do so and will limit it to what is reasonably necessary for the shared trip.
MERRE does not issue tickets or reservations and does not become a party to a booking merely because it stores or extracts booking information.
10. Photos and media
Photos are kept locally for private trip albums. MERRE does not provide a public feed, followers or public album sharing.
Photos explicitly selected for Memories may also be saved to private, account-scoped cloud storage within the available allowance. Uploaded derivatives have embedded metadata removed and pass malware-scanning/reconstruction gates. Originals and raw EXIF/GPS remain local. Failed cloud saves do not delete the local photo and require explicit retry. These are private albums, not a public-sharing service; see the Privacy Notice for processing, retention and deletion.
If MERRE materially changes cloud-media processing or introduces sharing, it will update these Terms and the Privacy Notice before the new processing begins. The current private-cloud feature does not grant permission to publish another person's images.
11. Your content and limited licence
As between you and MERRE, you retain any rights you have in travel notes, uploaded material, photos, prompts, edits and other content you provide (“User Content”).
You grant MERRE a non-exclusive, worldwide, royalty-free licence, limited in purpose and duration, to host, reproduce, format, transmit, process and create technical derivatives of User Content only as reasonably necessary to:
- provide features you request, including AI processing;
- display and edit content for you;
- save and restore account plans and selected private Memories, and provide MERRE+ backup while entitlement permits it;
- secure, troubleshoot and maintain the Service;
- comply with law and enforce these Terms; and
- exercise rights that survive deletion under mandatory law.
This licence does not authorise MERRE to publish your private User Content, sell it, use it in advertising, or train third-party AI models unless a later notice and valid legal basis expressly permit that use. The licence ends when the content is deleted, except for temporary technical copies, legal retention and rights that by nature must survive.
You promise that you have the rights and permissions necessary to submit User Content and that doing so does not unlawfully infringe privacy, confidentiality, copyright, trademark or other rights.
12. AI output and intellectual-property uncertainty
Subject to mandatory law and third-party rights, MERRE does not claim ownership of the particular itinerary or other output generated for your permitted private use. AI output may not qualify for copyright, may resemble output given to others and may include material subject to third-party rights. MERRE does not warrant exclusivity, originality, non-infringement or copyrightability.
The consumer Service and its AI output are licensed for personal, non-commercial use only. You may not publish, sell, license, redistribute or otherwise exploit AI output commercially unless MERRE gives separate express written authorisation under separate applicable terms. You remain responsible for reviewing any output before permitted publication or use. This contractual restriction concerns use of MERRE's consumer Service and does not claim copyright in material that the law does not protect.
13. MERRE intellectual property
The Service, software, brand, interfaces, visual design, databases, curated content, trademarks, logos and related intellectual property—excluding User Content and third-party material—belong to MERRE or its licensors.
Subject to these Terms, MERRE grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable right to use the available consumer Service for its intended purposes. No source code, trademark or ownership right is transferred.
You may not copy, scrape, frame, republish, sell, license, reverse engineer or create derivative products from protected parts of the Service except to the extent an applicable law expressly permits and cannot be excluded by contract.
14. Feedback
If you voluntarily send product suggestions that do not contain User Content or confidential/personal information, you grant MERRE a non-exclusive, perpetual, worldwide, royalty-free right to use and adapt those suggestions to improve the Service without an obligation to compensate you. This does not transfer ownership of your travel record, photos or private content.
Feedback may be submitted through the in-app feedback route or the contact email. Do not include confidential or unnecessary personal information. Personal data in feedback is handled under the Privacy Notice and the applicable support-record retention criteria.
15. Acceptable use
You must not:
- use the Service unlawfully or to facilitate harm;
- submit content you have no right to use;
- impersonate another person or misrepresent affiliation;
- attempt to access another user's account or private data;
- bypass authentication, App Check, entitlements, quotas, rate limits or security controls;
- introduce malware, malicious files or destructive code;
- probe, scan or test vulnerabilities without prior written authorisation, except where mandatory law protects good-faith security research;
- overload, disrupt or interfere with the Service or provider infrastructure;
- automate extraction, scraping or bulk requests contrary to published technical controls;
- reverse engineer except to the limited extent mandatory law allows;
- use AI features to create illegal, abusive, exploitative, deceptive or rights-infringing material;
- submit child sexual abuse material, non-consensual intimate material, trafficking content or material exploiting a child;
- use the Service to make unauthorised bookings, fraudulently obtain services or evade payment;
- resell or provide access to the consumer Service as a competing service without permission; or
- use the Service or its outputs for commercial, professional or business purposes unless MERRE has given separate express written authorisation or separate business terms apply.
These restrictions are interpreted proportionately and do not prevent rights that cannot be waived.
MERRE does not publish user content, and your albums and travel records are visible only to you. If you nevertheless believe the Service is being used for something illegal, you can report it to wander.travel.app1@gmail.com.
16. Third-party services, official sources and links
Maps, places, images, AI, authentication, billing and other functions rely on independent providers. Google Play, Google/Firebase/Gemini, Mapbox, Geoapify, RevenueCat, Superwall, Unsplash and any future reviewed travel partner may apply their own terms and privacy notices.
MERRE is not responsible for a third party's independent product, content, pricing, availability, contract, refund decision or data practice, except where mandatory law makes MERRE responsible for its selection, instructions or integration.
Links to official authorities are provided to help verification; MERRE does not control those sites.
17. Affiliate relationships
Affiliate functions are not currently available. If MERRE later enables a travel partner, MERRE may earn a commission if you open or transact with that partner. MERRE will disclose this prominently before you leave the app, and the partner may use cookies or tracking under its own policy.
Opening a partner is always optional, and MERRE does not preload the destination. Commission does not increase the price unless expressly disclosed, and MERRE will not let commission secretly determine a recommendation presented as neutral.
18. MERRE+ prices, billing and renewal
MERRE+ is purchased through Google Play in the Android distribution model. The paywall and Google Play confirmation display before purchase:
- the exact product and included material features;
- price, currency, taxes where required and billing period;
- subscription duration and automatic renewal;
- any free or discounted trial, its duration and the post-trial price;
- when payment is charged;
- how to cancel;
- the effect of cancellation, billing retry, grace period, expiry and refund;
- the 30-day cloud-backup read-only period after entitlement expiry; and
- material country, device or feature restrictions.
MERRE+ is offered as an auto-renewing yearly subscription and, in some parts of the purchase flow, as an auto-renewing weekly subscription. Eligible new customers may be offered a seven-day free trial of the yearly plan, and eligible accounts may be offered a discounted yearly price. Each offer, its price and its eligibility are shown on the purchase screen before you buy. Google Play automatically supplies the applicable localized price, currency, tax display, charging schedule, eligibility and renewal date to RevenueCat and the Play purchase confirmation. Those transaction-specific disclosures form part of the purchase terms and control over any stale general description. MERRE will not start checkout when the current localized store price is unavailable and will not describe a trial unless the store reports that the account is eligible.
MERRE may change the MERRE+ price for future billing periods. A price change never applies to a period you have already paid for. Google Play notifies existing subscribers of a price change in advance under its own rules, including asking for your agreement where those rules or the law require it, and you can cancel before the new price applies.
If a renewal payment fails, Google Play may apply a grace period and an account hold while payment is retried. Those recovery settings may preserve or suspend access while payment is retried and may change prospectively through Google Play. They do not extend the paid subscription term or remove mandatory rights.
Fixed prices are not duplicated in these general Terms because Google Play supplies the current localized transaction price. The purchase screen and Google Play confirmation control the transaction-specific price, offer eligibility and charging date; these Terms control the general Service conditions.
Subscriptions renew automatically unless cancelled through Google Play before renewal under the store rules displayed to you. Cancellation normally stops future renewal and does not necessarily terminate access before the paid period ends. Deleting MERRE or the MERRE account does not by itself cancel a store subscription; MERRE warns you about this in the app and links to the store cancellation route.
If Google Play or another approved store administers a transaction, its billing terms also apply. Store processes do not remove rights that mandatory Romanian/EU consumer law gives you against MERRE.
19. Withdrawal, cancellation, refunds and statutory remedies
EEA consumers generally have a 14-day right of withdrawal from a distance service contract, subject to statutory conditions and exceptions. Google Play's checkout states when digital content will be supplied immediately and obtains the acknowledgement it applies to that purchase. If MERRE+ is legally classified as a digital service rather than digital content, immediate performance does not by itself remove the withdrawal right; any proportionate charge or exception applies only when all statutory conditions are met.
To exercise an applicable withdrawal right, use Google Play's refund/withdrawal process or email wander.travel.app1@gmail.com with: your name; Google Play order identifier; purchase date; a clear statement that you withdraw from the MERRE+ contract; and the date. Do not send payment-card details. A model statement is: “I hereby give notice that I withdraw from my contract for MERRE+, ordered on [date], under Google Play order [identifier]. Name: [name]. Date: [date].” This route does not limit a simpler unambiguous withdrawal statement allowed by law.
You also retain mandatory remedies if the digital service is not supplied or is not conforming, including bringing the service into conformity, proportionate price reduction, termination and refund where the statutory conditions are met. No “all sales final,” “as is” or store-only clause overrides those rights.
MERRE does not offer an automatic voluntary service-credit or service-level compensation scheme. Mandatory refund, price-reduction, withdrawal and conformity remedies remain unaffected. MERRE may provide a discretionary goodwill credit or refund in an individual case without creating a continuing entitlement or precedent. Google Play refund requests may be made through <https://support.google.com/googleplay/answer/15575720>; purchase-support requests may also be sent to the MERRE contact email.
20. Updates and service modifications
MERRE may modify, replace, restrict, update or discontinue features for valid reasons, including legal or regulatory requirements; security, safety, fraud or abuse prevention; technical, interoperability or compatibility requirements; third-party service, API or model changes; infrastructure changes; reliability or performance improvements; maintenance; product development; and operational necessity.
Changes needed to maintain conformity, including security updates, may be required. You are responsible for installing updates made available to you, after being informed of consequences where the law requires.
For a continuously supplied paid digital service, a modification beyond what is needed for conformity will:
- have a valid reason stated in these Terms or the relevant notice;
- impose no additional price during the current paid term without agreement;
- be communicated clearly; and
- where it negatively affects access/use more than minimally, be notified in advance on a durable medium with any statutory right to terminate or retain an unchanged conforming version.
MERRE does not reserve an unlimited right to remove paid value while keeping payment. Material adverse changes remain subject to Romanian OUG 141/2021 and other mandatory law.
21. Availability, maintenance and experimental features
Features expressly labelled beta, preview, experimental or “coming soon” may be incomplete, unavailable or changed before general release. A “coming soon” label is not a promise of a release date. Experimental labels do not reduce mandatory duties for functionality that MERRE actually supplies to a consumer.
MERRE may perform maintenance and may experience outages, network/provider failures or events outside reasonable control. We do not promise uninterrupted or error-free operation. We will use the care required by applicable law, provide security/conformity updates where required and provide mandatory remedies for material non-supply or nonconformity.
If MERRE plans to permanently discontinue the Service, it will aim to give at least 30 days' advance notice where reasonably practicable and provide a reasonable opportunity to export eligible data. A shorter period or no advance notice may be necessary because of law or regulatory action, urgent security or safety concerns, force majeure, loss of essential third-party infrastructure, technical impossibility or other circumstances outside MERRE's reasonable control. For an unused prepaid subscription period, MERRE will provide the refund or proportionate reimbursement required by applicable law; no additional compensation is promised unless MERRE expressly grants it.
22. Suspension and account termination
MERRE may restrict or suspend an account where reasonably necessary because of:
- a security compromise or credible risk;
- fraud, payment abuse or unauthorised access;
- illegal use;
- a material or repeated breach of these Terms;
- conduct threatening systems, users or providers;
- a legal or regulatory requirement;
- non-payment or loss of entitlement for paid-only functionality; or
- discontinuation of the Service subject to mandatory notice and remedies.
Except where immediate action is reasonably necessary for security, harm prevention or law, MERRE will provide available reasons, proportionate notice and an opportunity to cure where appropriate. Restrictions must not prevent legally required access, export, deletion, complaint or refund remedies.
You may stop using the free Service and request account deletion at any time. Subscription cancellation is separate and occurs through Google Play unless applicable law or the purchase flow provides another route.
23. Privacy and deletion
The Privacy Notice explains processing, retention and rights. Account deletion is designed to remove local and cloud account-associated data and trigger applicable processor workflows, subject to limited legal retention and residual backups disclosed in that Notice.
Deletion is irreversible once completed. You should export data first. MERRE may retain minimized acceptance, transaction, dispute or security records only where a lawful basis and defined retention period justify doing so.
24. Statutory conformity and warranties
MERRE will supply the digital Service with the subjective and objective conformity required by applicable law, including described functionality, compatibility, continuity and security updates where required.
Except for express commitments in these Terms and mandatory legal guarantees, and to the maximum extent permitted by law, MERRE does not promise that:
- every suggestion will suit personal preferences;
- third-party information will remain current;
- a route, venue, price or booking will be available;
- AI output will be unique or free from all errors; or
- the Service will operate without occasional interruption.
These qualifications describe inherent product limits; they do not remove statutory remedies.
25. Limitation of liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for fraud or intentional misconduct, gross negligence where it cannot be limited, death or injury to physical or mental integrity caused by legally attributable conduct, breach of mandatory consumer rights, unlawful personal-data processing, or any other non-excludable liability.
Subject to that paragraph, MERRE is responsible for direct loss that was reasonably foreseeable when the contract was formed and caused by MERRE's breach. MERRE is not responsible for loss caused by:
- your failure to verify clearly identified AI or third-party information;
- your unauthorised or unlawful use;
- independent decisions or failures of a travel provider, authority or platform;
- loss of local-only data following device loss, uninstall or deletion where MERRE supplied clear backup information; or
- an event outside reasonable control that MERRE could not reasonably prevent, subject to mandatory continuity and refund duties.
To the extent lawful for a consumer contract, MERRE is not liable for remote, exceptional or unforeseeable loss, loss arising from business/professional use of a consumer Service, or loss that could reasonably have been avoided through ordinary mitigation.
Overall limit
Subject always to the first paragraph of this Section, MERRE's total liability to you for all claims arising out of or relating to these Terms or the Service, whether in contract, tort or otherwise, is limited to the greater of:
- the total amount you paid for MERRE+ in the 12 months before the event giving rise to the first claim; and
- EUR 100, or its equivalent in your local currency.
This limit never reduces or replaces: a refund, price reduction or other remedy for withdrawal, non-supply or non-conformity of the Service; liability for intent or gross negligence; liability for death or injury to the person; compensation owed under data-protection law, including Article 82 GDPR; or any other liability that the law governing the claim does not allow to be limited. If you are a consumer in the EEA, the United Kingdom or Switzerland, the limit applies only to the extent it is compatible with the mandatory consumer law that protects you.
Any exclusion or limitation in these Terms applies only to the maximum extent permitted by the mandatory law governing the particular claim.
Users outside the EEA, the United Kingdom and Switzerland
If you live outside the EEA, the United Kingdom and Switzerland, the following also applies to the extent permitted by the law of the country where you live:
- the Service and AI output are provided “as is” and “as available”, and MERRE disclaims implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, except for the express commitments in these Terms;
- MERRE is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, even if advised of their possibility; and
- you will compensate MERRE for reasonable losses and costs, including reasonable legal fees, arising from a third-party claim caused by your breach of Section 15 or by User Content you had no right to submit, except to the extent the claim was caused by MERRE.
Some jurisdictions do not allow certain disclaimers or limitations, so some of them may not apply to you. Nothing in this subsection limits rights that the law of your country makes mandatory.
26. User responsibility for culpable harm
To the extent permitted by mandatory consumer law, you are responsible for direct, reasonably foreseeable loss that you intentionally or culpably cause MERRE through unlawful conduct, material breach of the acceptable-use rules, or submission of content you had no right to provide.
This is not a blanket indemnity, does not require payment for MERRE's own fault, and does not remove defences or protections available to consumers under applicable law.
27. Force majeure
Neither party is liable for delay or failure caused by an event beyond reasonable control to the extent the event actually prevents performance and reasonable mitigation was taken. This may include major network/provider outages, natural disasters, war, civil emergency, government action or widespread infrastructure failure.
This clause does not excuse payment already due for a conforming period, prevent statutory termination/refund remedies for prolonged non-performance, or exclude obligations that cannot lawfully be excluded.
28. Changes to these Terms
We may change these Terms for a valid reason, including a legal/regulatory change, security need, provider or technical change, or material product change. We will publish the new version and effective date.
For material changes, we will provide reasonable advance notice and request renewed acceptance where required. Changes are not retroactive. If a material change adversely affects a paid ongoing service, mandatory notice, cancellation, termination and refund rights apply. Continued use alone will not be treated as agreement where law or the nature of the change requires an affirmative acceptance.
29. Governing law, disputes and consumer jurisdiction
These Terms are governed by Romanian law, without depriving a consumer of mandatory protection available under the law of the consumer's habitual residence where EU or other applicable conflict-of-law rules preserve it.
If you live outside the EEA, the United Kingdom and Switzerland, and to the extent the law of your country permits, the courts of Oradea, Romania have jurisdiction over disputes arising from these Terms, without limiting any mandatory right you have to bring proceedings where you live.
Where legally permissible, please first submit the dispute to wander.travel.app1@gmail.com and allow a reasonable period for good-faith informal resolution before starting proceedings. This process does not waive, restrict or unlawfully delay a mandatory consumer remedy, regulatory complaint, statutory deadline or right of access to a competent court.
Consumers may bring proceedings in courts available under mandatory jurisdiction rules, including courts of their domicile where Brussels I bis applies. MERRE may bring proceedings against a consumer only in courts permitted by mandatory law. These Terms do not impose mandatory arbitration, a class-action waiver or exclusive Romanian courts on a consumer where that would be unenforceable.
Consumers may contact the Romanian National Authority for Consumer Protection (ANPC) at <https://anpc.ro/> or use ANPC's alternative-dispute-resolution information and complaint routes, including <https://reclamatiisal.anpc.ro/> where applicable. A consumer may also contact another competent consumer authority. MERRE does not direct users to the discontinued EU ODR platform.
30. General provisions
Assignment
You may not transfer the account itself. MERRE may transfer this contract as part of a genuine reorganisation, sale or transfer of the Service only where the transfer does not reduce mandatory rights and required notice is provided. A transfer does not permit undisclosed repurposing of personal data.
Notices
MERRE may send you notices about the Service, these Terms or your subscription by email to the address of the Google account you use for MERRE, or in the app. You can send notices to MERRE at wander.travel.app1@gmail.com.
No waiver
Failure or delay in enforcing a right does not waive it.
Severability
If a provision is invalid or unenforceable, it will be disregarded or limited only to the minimum extent required. The remainder continues where it can operate fairly and lawfully. A court may not rewrite an unfair consumer term merely to preserve an advantage prohibited by law.
Entire agreement
These Terms, the purchase disclosures and any feature-specific terms form the agreement about the Service. The Privacy Notice explains processing and is not used to contract out of data-protection law. Mandatory pre-contract statements and consumer rights remain effective.
Order of priority
For a conflict, mandatory law prevails. Then a specific purchase/feature term prevails over these general Terms for that subject. A store term governs the store's own billing process but does not remove MERRE's obligations.
Survival
Provisions that by nature must continue—including accrued payment/refund rights, intellectual-property protection, limited content-processing rights during lawful retention, liability, dispute and interpretation terms—survive termination only for as long as necessary and lawful.
Headings
Headings aid reading and do not change meaning. Ambiguity in a standard consumer term is interpreted as mandatory law requires, including in the consumer's favour under Romanian law.
